PROBATE

MEDIATION

Mediation is an alternative dispute resolution process where parties in a dispute agree to allow a mutually selected neutral third party assist them in negotiating their dispute in an attempt to resolve their differences. The neutral person selected by the parties to help them resolve their differences is called a mediator. Typically, but not always, a mediator is an attorney, retired judge, or someone specifically trained in mediation. Ideally, a mediator will have subject matter expertise or other specific knowledge or experience that enables the mediator to better assist parties in resolving their differences.

Korey M. Kidwell graduated cum laude from Capital University Law School with a concentration in Dispute Resolution. While in law school, he handled small claims mediation cases in Franklin County Municipal Court. Throughout his career, Korey has guided clients through the mediation process in a number of counties throughout Ohio.

ESTATE PLANNING

An estate plan is a way to make sure the things you have worked for and acquired over your lifetime get to where you want them to go. Your estate plan can be as simple as a will or as complex as a trust. Many people believe that an estate plan is only for those who have a lot of money, but this is not the case. For example, if you have children, you need an estate plan so you can decide who will take care of your children if something happens to you and your spouse. If you do not make this decision, it could end up in the hands of the court and someone who you would not have chose may be the guardian over your child.

An estate plan is not just making sure your property gets to where you want it to, but it also includes a financial power of attorney designating who you want to make decisions over your finances if you are unable to make those decisions. It also includes a health care power of attorney designating someone to make health care decisions for if you are unable to do so.

EVICTIONS

Do you have a tenant who has defaulted on their lease? If the answer is yes, you may need to go through the legal process of evicting them. This process starts with either a 3-day or 30-day notice to leave the premises and may lead to an eviction hearing in front of the judge.
